SB 6 Summary

• Establishes industrial hemp as a legal agricultural crop in Alaska, defined as Cannabis sativa L. containing not more than 0.3 percent delta-9-tetrahydrocannabinol (THC)

• Requires individuals producing industrial hemp to register with the Department of Natural Resources; registration valid for one year and renewable with fees covering regulatory costs

• Exempts industrial hemp from marijuana definitions and cannabidiol oil from hashish oil definitions in state criminal law, and clarifies that adding industrial hemp to food does not create an adulterated product

• Authorizes the Commissioner of Natural Resources to regulate hemp production through testing requirements, approved seed sources, isolation distances, and procedures to prevent unintended seed distribution; establishes $500 fine for unregistered production

• Requires the Department of Natural Resources to report to the legislature by December 1, 2024 on industrial hemp regulation including registration numbers, violations, stop orders, and economic effects; act takes effect immediately
