SB 63 Summary: Prohibition of Smoking in Certain Places

• Prohibits smoking of tobacco, e-cigarettes, and oral smoking devices in enclosed areas of public places including entertainment venues, public transportation, retail stores, government buildings, educational facilities, and health care facilities.

• Prohibits smoking in enclosed areas of private workplaces, offices, hotels, restaurants, bars, common areas of apartment buildings, child care facilities, and vessels operating as shore-based fisheries businesses.

• Prohibits outdoor smoking within 10 feet of playground equipment at public or private schools and parks (when children present), within 20 feet of entrances to certain buildings where smoking is prohibited indoors, and in seating areas of outdoor arenas and stadiums.

• Allows exceptions for retail tobacco/e-cigarette stores (if freestanding or separately ventilated), private clubs operating since January 1, 2017, single-occupant work vehicles, commercial fishing vessels, and marijuana establishments under state regulations.

• Permits municipalities to adopt ordinances exempting themselves from these requirements, and allows established villages to hold local option elections to allow smoking in public places with approval of 35 percent or more of registered voters; establishes civil fines of $50 for individuals and $50-$300 for businesses that violate smoking prohibitions.
