SB 68 Summary

• Prohibits railroad corporations from blocking, limiting access to, or charging adjacent landowners for use of railroad rights-of-way as defined in federal law (45 U.S.C. 1202(11)).

• Allows corporations to enjoin adjacent landowner use only if it materially interferes with rail operations or creates substantial safety issues.

• Requires corporations to record a notice of adjacent landowner rights in recording districts where they previously recorded patents describing railroad rights-of-way.

• Defines "adjacent landowner" as a patent holder whose property is adjacent to a railroad utility corridor, with title vested before January 1, 1983, and containing or required to contain a reservation for the Alaska Railroad under the Alaska Railroad Act of 1914.
