Amends AS 11.41.425(a)(4) to expand sexual assault in the third degree to include peace officers who engage in sexual penetration with victims, witnesses, or perpetrators of crimes under their investigation, in addition to those in custody or apparent custody of the officer.

Amends AS 11.41.427(a)(3) to expand sexual assault in the fourth degree to include peace officers who engage in sexual contact with victims, witnesses, or perpetrators of crimes under their investigation, in addition to those in custody or apparent custody.

Adds affirmative defense under AS 11.41.432(c) allowing peace officers charged under the new provisions to demonstrate they had a dating or sexual relationship with the person before that person became a victim, witness, or perpetrator of a crime under the officer's investigation, and the relationship continued until the offense date.

Applies the law only to offenses committed on or after the effective date of the Act.
