HB 14 Summary

• Adds new first-degree assault crime: knowingly causing another person to become unconscious by means of a dangerous instrument, which includes hands, body parts, or objects used to impede breathing or blood circulation on the throat, neck, nose, or mouth.

• Expands definition of "dangerous instrument" to include hands and body parts when used to impede normal breathing or blood circulation.

• Adds strangulation resulting in unconsciousness as an aggravating factor at sentencing that allows imposition of sentences above the presumptive range.

• Removes sex offenses from eligibility for sentence credit for time spent in treatment programs or under electronic monitoring.

• Requires prosecuting attorneys to confer with victims before entering into plea agreements and record whether victims agree with proposed pleas; expands victim notification requirements for sex offenses and domestic violence cases.
