Adds affirmative defense to driving under the influence charges under AS 28.35.030(a) when defendant's vehicle operation was limited to using the heater or starting the vehicle to use the heater.

Requires that a reasonable person would seek shelter and heat given the temperature or weather conditions at the time of vehicle operation.

Requires defendant did not otherwise drive or attempt to drive the motor vehicle beyond operating the heater.

Applies to offenses committed on or after the effective date of the Act.
