AK HB20

Removes the requirement that offenders "know" a victim is mentally incapable, incapacitated, or unaware in first, second, and third degree sexual assault statutes, making it easier to prosecute these offenses.

Requires law enforcement agencies to send sexual assault examination kits to accredited laboratories within 30 days of collection and ensure testing occurs within one year.

Mandates law enforcement agencies notify victims within two weeks after laboratory testing is completed.

Requires annual inventories by September 1 of untested sexual assault examination kits, with reporting to the Department of Public Safety on kit numbers, collection dates, and reasons for ineligibility.

Establishes that sexual assault examination kits are ineligible for testing only if scientifically unviable, do not meet Combined DNA Index System database requirements, or were collected from a person who wishes to remain anonymous.

Takes effect January 1, 2021.
