CSSB 1(HSS) Summary

• Repeals Alaska's certificate of need (CON) program for health care facilities, eliminating the requirement for facilities to obtain approval before construction, acquisition, or major modifications.

• Repeals multiple statutes governing the CON program (AS 18.07.021 through 18.07.111 and related provisions in AS 21.86.030 and AS 44.64.030).

• Prohibits the Department of Health and Social Services from revoking, enforcing, or modifying certificates of need issued before the effective date.

• Amends definitions of "health care facility" and "residential psychiatric treatment center" to remove references to repealed CON statutes and update cross-references.

• Takes effect July 1, 2024, with the exception that transition regulations authority takes effect immediately.
