SB 138 Summary

• Requires correctional facilities for state prisoners to be located in Alaska, except when the commissioner finds in writing that out-of-state placement is necessary to locate a prisoner closer to family or due to health considerations.

• Prohibits the commissioner from entering into agreements with private agencies to establish, operate, or maintain correctional facilities within Alaska.

• Allows the commissioner to designate out-of-state facilities for prisoner placement only if rehabilitation or treatment will not be substantially impaired and the placement serves to keep the prisoner closer to family or addresses health needs.

• Requires any agreement with a private agency to provide facilities outside the state to be based on competitive bids, notwithstanding other procurement requirements.

• Applies only to contracts entered into on or after the effective date, which is immediate upon enactment.
