Utilities must provide customers written notice by first class mail at least 60 days before installing a smart meter, stating the intent to install, explaining how to opt out, and disclosing any associated fees.

Customers may elect to refuse smart meter installation or require removal of existing smart meters by notifying the utility in writing.

The commission shall set maximum surcharges for customers who refuse smart meters, including one-time and monthly fees for meter removal, installation, reading, maintenance, and service, with possible reductions or elimination for public assistance program recipients.

Utilities must secure smart meter data and cannot disclose customer energy use information to third parties without written customer consent, except as required by court order or law.

Smart meter requirements under AS 42.05.355 are made applicable to all utility categories, including public subdivisions, small utilities, and cooperatives that were previously exempt from most utility regulations.
