SB 146 Summary

• Creates a new crime of "selling a cigarette" making it illegal to offer for sale or possess with intent to sell one or more cigarettes, punishable by a fine of not less than $300.

• Removes cigarettes from cigarette tax licensing provisions by changing regulations to allow only importation (not sale, distribution, or acquisition) of cigarettes and eliminating manufacturer, distributor, and vending machine operator license categories.

• Eliminates vending machine sales of cigarettes and updates various state statutes to remove references to cigarette sales while retaining regulations for cigars, tobacco products, electronic smoking products, and nicotine products.

• Repeals numerous statutes related to cigarette manufacturing, distribution, taxation, and stamping requirements that are no longer applicable under the prohibition.

• Takes effect July 1, 2021, except for regulatory authorization provisions which take effect immediately.
