SB 235 - Student Data & Assessments Summary

• Requires school districts to adopt and publish data security plans that describe student data fields collected, reasons for collection, entities with access, and safeguards protecting personally identifiable information.

• Prohibits schools, school districts, and the department from using student data containing personally identifiable information for commercial purposes, including marketing, list compilation, or product development.

• Restricts release of student data with personally identifiable information to consortiums or interstate educational organizations without parental or guardian consent.

• Allows parents or guardians and emancipated or 18+ year-old students to opt out of any statewide student assessment.

• Defines "student data" to include electronic information collected by schools, information stored by third-party contractors providing cloud services, and electronic communications created on school servers; effective July 1, 2020.
