CSSB 32(STA) - Criminal Law and Procedure Bill

• Increases sentencing ranges for felonies, including raising class A felony presumptive sentences from 3-8 years to 5-8 years for first-time convictions and increasing probation periods to 10-15 years for class A/B felonies.

• Creates new "misconduct involving a controlled substance in the second degree" felony (class A) for manufacturing methamphetamine and related conduct; reorganizes controlled substance offense classifications into five degrees.

• Modifies escape statutes to criminalize removing, tampering with, or disabling electronic monitoring equipment or leaving designated residence without authorization for persons under electronic monitoring.

• Simplifies theft statutes by removing inflation adjustment references and repealing separate theft degree provisions; consolidates theft thresholds at $250, $750, and $25,000.

• Requires superior courts to report involuntary commitment orders to the Department of Public Safety for firearm background check purposes; effective date July 1, 2019, except involuntary commitment reporting takes effect immediately.
