CSSB 76(L&C) - Workers' Compensation Appeals Commission Repeal

• Repeals the Workers' Compensation Appeals Commission effective June 1, 2020, and transfers appeal jurisdiction from the Commission to the superior court.

• Establishes new statute AS 23.30.126 setting standards for superior court review of Alaska Workers' Compensation Board decisions, including standards for staying compensation payments and requiring board findings of fact to be conclusive if supported by substantial evidence.

• Permits the director of the division of workers' compensation to intervene in appeals or file appeals in superior court for unsettled questions of law when a party lacks attorney representation.

• Requires pending Commission cases as of December 1, 2020, to remain under the old appellate rules and be transferred to superior court on December 2, 2020, with new appeals filed on or after June 1, 2020, going directly to superior court.

• Repeals multiple Alaska Statutes related to the Commission's operation and amends Alaska Rules of Appellate Procedure Rules 201.1, 401.1, 501.1, and others to reflect the jurisdictional shift to superior court.
