Employers publishing job notices, advertisements, or solicitations must include a description of compensation, including salary or salary range for the position.

Employers are prohibited from preventing employees or applicants from disclosing their own compensation, discussing others' compensation, or asking about others' pay.

Employers may not ask applicants about compensation received from previous employers.

Employers are prohibited from retaliating against employees who exercise wage disclosure rights, with violators subject to fines of $100-$2,000 per violation and employees able to file civil claims for damages including reinstatement and lost wages.

Employers must post a commissioner-approved summary of wage disclosure requirements in a conspicuous workplace location; the Act takes effect July 1, 2021.
