Commissioner of Public Safety must adopt regulations requiring inspection and testing of fire dampers, smoke dampers, combination fire and smoke dampers, and smoke control systems consistent with NFPA 80 (2022), NFPA 92 (2021), and NFPA 105 (2022) standards.

Regulations apply to mental institutions, penal institutions, group residential facilities, nursing homes, hospitals, schools, sleeping buildings, public assembly buildings, state and municipal buildings, and any other buildings where such dampers or systems are installed.

State, municipalities with fire and life safety inspection programs, or persons with current fire and life safety certification accredited by the American National Standards Institute (ISO/IEC 17024) must conduct inspections and testing.

Inspectors must submit noncompliance findings to both the building owner and the state fire marshal.

Department of Public Safety may establish reasonable fees for inspections and testing, with receipts deposited according to statute; effective date is January 1, 2023.
