Independent qualified health care professionals must review annual assessments; qualifications vary by waiver type (intellectual disability professionals or registered nurses for other waivers).

Department must notify recipients in writing within 10 days of assessment results and within 10 days of eligibility determinations, with at least 30 days' notice before changes take effect, and inform recipients of appeal rights.

Legally responsible persons may provide personal care services to recipients unless prohibited by federal law; Department of Health must submit a report within one year assessing payment rates, service adequacy, waitlist data, and recommending statutory changes.
