HB 347 Summary

• Amends AS 03.05 to make animal records maintained by the Department of Environmental Conservation confidential and exempt from the Alaska Public Records Act if they identify a particular animal, breed, business, or individual; contain test results or test samples; or include trade secrets or proprietary business/financial information.

• Allows the Department of Environmental Conservation to disclose confidential animal records to state, federal, local government agencies, or regional health corporations if a threat to animal health, safety, or public health exists and disclosure is necessary to address the threat.

• Requires the Department of Environmental Conservation to publicly disclose animal records upon request in a manner that prevents identification of particular animals, individuals, or businesses.

• Authorizes the Department of Environmental Conservation to adopt implementing regulations under the Administrative Procedure Act, effective on or after the law's effective date.

• Section 2 of the Act takes effect immediately; remaining provisions take effect on the effective date.
