CSHB 51(JUD) Summary

• Amends AS 12.55.155(c) to add two new aggravating factors that allow courts to impose sentences above the presumptive range: (1) defendant knowingly directed conduct at a victim because of sexual orientation or gender identity, and (2) defendant knowingly caused victim to become unconscious using a dangerous instrument.

• Expands factor (22) to include "sexual orientation or gender identity" and "citizenship" as protected characteristics when defendant knowingly directs conduct at a victim based on these characteristics.

• Applies only to offenses committed on or after the effective date of the Act.
