Legislature finds that maintaining fairness in athletic opportunities for women is an important state interest and that biological differences between males and females provide competitive advantages to male athletes.

Public schools and private schools competing against public schools must designate each athletic team or sport as male/men/boys, female/women/girls, or coeducational/mixed.

Students participating in female/women/girls teams must be female based on biological sex as designated at birth, with birth certificates accepted as evidence of biological sex.

Schools and school districts are protected from adverse action by governmental entities, licensing organizations, or athletic associations for complying with the designation requirements.

Students deprived of athletic opportunities or harmed by violations may bring private lawsuits against violating schools, and students subjected to retaliation for reporting violations may sue the retaliating entity within two years of the event.
