Department of Public Safety must adopt regulations requiring inspection and testing of fire dampers, smoke dampers, combination fire and smoke dampers, and smoke control systems consistent with NFPA 80 (2022 edition), NFPA 92 (2021 edition), and NFPA 105 (2022 edition).

Regulations apply to mental institutions, penal institutions, group residential facilities, intermediate care facilities, nursing homes, hospitals, schools, buildings used for sleeping purposes, public assembly buildings, state and municipal buildings, and any other buildings with installed dampers or smoke control systems.

Inspections and testing must be conducted by the state, a municipality with a fire and life safety inspection program, a registered mechanical engineer, a licensed fire protection engineer, or a person with current fire and life safety certification issued through an American National Standards Institute accredited program.

Inspectors must submit findings of noncompliance to the building owner, state fire marshal, and the municipal fire and life safety inspection program office if applicable.

Commissioner of Public Safety may establish reasonable fees for fire and life safety plan checks and for inspections and testing of dampers and smoke control systems, effective January 1, 2023.
