Director of insurance may order health care insurers to waive utilization review requirements during recognized federal or state public health disasters or emergencies, including preauthorization, concurrent review, retrospective review, and emergency services requirements.

Health care providers licensed in another jurisdiction may provide telehealth services without in-person physical examinations, excluding controlled substances, if services are within their authorized scope of practice and provider advises patient if encounter extends beyond scope.

Telehealth providers must charge reasonable fees consistent with ordinary fees for those services and cannot charge for encounters they terminate due to scope limitations.

Hospitals and nursing facilities may employ persons without Department of Health and Social Services background checks if they document their hiring process vetting and obtain background checks by July 1, 2022.

Home care and waiver service providers with 200+ employees may employ persons without department background checks if they use approved pre-employment vetting systems with fingerprint-based checks substantially similar to state requirements and obtain background checks by July 1, 2022.
