SB 63 Summary

• Allows an interested person to petition a court for appointment as temporary guardian of a missing adult to access the missing person's financial institution records and wireless telephone service records to aid in locating them.

• Court may grant temporary guardianship if it determines the individual is missing, imminent danger exists to their physical health or safety, and record access may help locate them.

• Petitioner must demonstrate a reasonably diligent search including contacting law enforcement and public welfare agencies, publishing notices in newspapers, or hiring an investigator.

• Temporary guardianship lasts no longer than 30 days, and the temporary guardian may only view records but cannot use them for financial transactions or other purposes beyond locating the individual.

• Defines "interested person" as anyone related by blood, marriage, or adoption, friends of the missing person, or persons who have demonstrated interest in their welfare.
