CS FOR SENATE BILL NO. 82(JUD) - Elections and Election Investigations

• Creates a civil enforcement process for election law violations, requiring complaints to be filed within 60 days after election certification or the alleged violation date, whichever is later.

• Directs the division to refer complaints alleging violations of AS 15.13 (public offices/ethics) to the Alaska Public Offices Commission and may refer other complaints to the attorney general.

• Grants the attorney general broad investigative powers including authority to issue subpoenas, subpoena duces tecum, interrogatories, and request records from state agencies; subpoena recipients must respond within 30 days unless expedited by court order.

• Authorizes the attorney general to bring civil actions seeking injunctive relief and recover fines up to $25,000 per violation plus reasonable attorney fees and investigation costs; actions against candidates or elected officials must be brought within two years of complaint filing.

• Designates investigation records and notices of findings as public records subject to public disclosure laws, except the attorney general's intelligence information remains confidential; allows private parties to file independent court actions.
