CS FOR SENATE BILL NO. 90(JUD) - Summary

• Allows wills to be created and executed using electronic means, including electronic signatures and electronic text, provided the will is readable as text at the time of signing.

• Permits witnesses and testators to be in "electronic presence" (real-time video and audio communication) rather than physical presence when executing or witnessing wills.

• Enables wills to be self-proved through acknowledgments and affidavits made in physical or electronic presence of an authorized officer, with updated certificate language to accommodate electronic execution.

• Allows individuals to create certified paper copies of electronic wills by affirming under penalty of perjury that the copy is complete, true, and accurate.

• Establishes that wills executed on or after the effective date are valid under the local law of Alaska, the jurisdiction where the testator was physically located when signing, or the jurisdiction where the testator was domiciled.

• Takes effect immediately upon enactment.
