HB 314 Summary

• Removes "investigation fees" from the list of occupational licensing fees that the Department of Commerce can collect, replacing them with a new definition of "regulatory costs" that excludes disciplinary investigations and unlicensed practice enforcement.

• Redefines "regulatory costs" to include department costs attributable to occupation regulation plus board expenses (either all expenses if a board regulates one occupation, or attributable expenses if a board regulates multiple occupations).

• Exempts costs for disciplinary investigations, unlicensed practice actions, and legal/actual costs associated with complaints, hearings, mediation, and settlements from the "regulatory costs" calculation used to set licensing fees.

• Removes "investigation" fee references from multiple occupational licensing statutes including pilots, maritime professionals, pharmacists, and other licensed professions, replacing them with "evaluation" language where applicable.

• Effective date: July 1, 2024.
