Blood banks must test all donated blood for evidence of messenger ribonucleic acid (mRNA) vaccine components or self-amplifying ribonucleic acid vaccine components, including lipid nanoparticles and spike proteins.

Blood donors must disclose during each donation screening whether they have previously received an mRNA vaccine or self-amplifying ribonucleic acid vaccine.

Blood containers must be labeled if the blood tested positive for vaccine components or was drawn from a donor who disclosed prior vaccination.

Healthcare providers administering labeled blood must inform the recipient or authorized representative of the vaccine-related status and provide the opportunity to refuse the transfusion.

Violations are classified as class A misdemeanors punishable by up to $1,000 in fines or up to six months imprisonment, or both; the law takes effect January 1, 2025.
