Individuals become eligible to receive permanent fund dividends for years they were ineligible due to a conviction if that conviction is vacated or reversed and either the charges are dismissed or they are retried and found not guilty.

Eligible individuals must apply for the permanent fund dividend no later than one year after the dismissal or not guilty finding.

The permanent fund dividend calculation under AS 43.23.025(a) is amended to include prior year dividends owed to individuals under the new eligibility provisions in the deduction of total available dividend payments.

Individuals whose dismissal or not guilty finding occurred before this Act's effective date have one year from the effective date to apply for permanent fund dividends under the new provisions.
