HB 360 Summary

• Establishes the Home Care Employment Standards Advisory Board within the Department of Health to advise on Medicaid payment rates and investigate wages, working conditions, and workforce adequacy for personal care, respite, and chore service workers.

• Board consists of 9 members: the health commissioner (nonvoting chair), the labor commissioner, and seven appointed members representing personal care agencies, personal care assistants, seniors, people with disabilities, and service recipients.

• Board shall meet at least three times annually, conduct investigations with subpoena power, and submit biennial reports with recommendations to the health commissioner and legislature regarding rates, service levels, working conditions, and workforce recruitment and retention.

• Department of Health must publish annual reports by July 1 each year showing weighted average and median hourly wages by agency for home care workers; first publication delayed to July 1, 2025.

• Act takes effect July 1, 2024, with the board's first meeting required by October 1, 2024, and commissioners to conduct preliminary investigation into workforce conditions before that meeting.
