HB 379 Summary: DUI Diversion Program

• Establishes a driving while under the influence (DUI) diversion program allowing first-time DUI offenders who meet eligibility requirements to avoid conviction through completion of treatment and other conditions.

• Eligible defendants must file a petition with a $490 filing fee within 30 days of their first appearance and agree to complete alcohol/substance abuse screening, treatment, abstinence from alcohol/drugs, and other court-ordered conditions over a one-year diversion period.

• Upon successful completion, the DUI charge is dismissed with prejudice; if the defendant fails to complete the program, the withheld guilty plea is entered and the defendant is sentenced.

• Modifies sentencing provisions to allow suspended imposition of sentence for diversion program participants and requires the Department of Administration to maintain records of all diversion agreements.

• Takes effect July 1, 2024, and requires the Department of Administration to adopt necessary implementing regulations.
