Director of personnel must eliminate one classified or partially exempt state position on June 30 of each odd-numbered year if it has been vacant for the preceding 728-day period.

A position is not considered vacant if any employee occupies or previously occupied it during the 728-day period, or has been hired to fill it even if employment begins in the following fiscal year.

An employee may be eligible to return to an eliminated position under AS 39.25.158.

The act applies to contracts taking effect after June 30, 2024, and becomes effective July 1, 2024.
