CSHB 398 - Controlled Substances Bill Summary

• Repeals subsection (1) of AS 11.71.030(a) and multiple provisions (subsections 4-8) of AS 11.71.040(a) related to misconduct involving controlled substances in the third and fourth degrees.

• Expands the definition of protected locations from schools to include day care centers, shelters for the homeless, and drug or alcohol treatment and rehabilitation centers in drug-free zone statutes.

• Adds affirmative defense language allowing prohibited conduct in private residences within 500 feet of protected locations if no distribution or intent to distribute for profit occurred.

• Requires municipalities to post drug-free zone signs at day care centers, shelters for the homeless, and drug or alcohol treatment and rehabilitation centers; excludes domestic violence shelters from the definition of "shelter for the homeless."

• Applies amendments to offenses committed on or after the effective date and to signs erected on or after the effective date.
