HB 88 Summary: Warehouse Work Quotas

• Applies to employers with 100+ employees at a single warehouse distribution center or 1,000+ employees statewide who use work quotas and directly or indirectly control working conditions through third-party employers or staffing agencies.

• Requires employers to provide written quota descriptions by January 31, 2025 (or upon hiring) that include the fulfillment period, number of tasks/materials required, and potential adverse employment actions for failure to meet quotas.

• Prohibits quotas that prevent employees from using bathroom facilities with reasonable travel time or that prevent compliance with federal or state occupational safety and health laws, and bars adverse employment action for failing to meet unlawful quotas.

• Allows current and former employees to request written quota descriptions and 90 days of work speed data within 21 calendar days; former employees limited to one such request.

• Enables employees to seek injunctive relief in superior court against employers violating these provisions; effective January 1, 2025.
