SB 18 Summary

• Allows the Department of Administration to issue electronic identification cards and electronic driver's licenses/permits to persons who already possess valid physical cards, available through a mobile application for a $50 fee.

• Requires persons to retain their physical identification cards and driver's licenses even after obtaining electronic versions; individuals may not be required to possess physical licenses in all circumstances per regulations.

• Establishes that presenting electronic licenses on mobile devices does not consent to searches of the device; peace officers must promptly return devices after verifying identity and are immune from liability for device damage except for intentional misconduct.

• Increases driver's license and permit fees: noncommercial vehicle licenses from $20 to $31, commercial licenses from $100 to $155, instruction permits from $15 to $23, and duplicates from $15 to $23.

• Takes effect January 1, 2024; requires the Department of Administration to adopt implementing regulations under the Administrative Procedure Act.
