SB 196 Summary

• Amends Alaska statute to allow employers to require drug and alcohol testing using urine, oral fluid, or breath samples for job-related purposes consistent with business necessity and employer policy.

• Permits testing for investigation of possible individual employee impairment, workplace accidents, safety maintenance, productivity and quality, or reasonable suspicion of drug or alcohol use affecting job performance.

• Specifies that accident testing must be administered as soon as practicable after an accident only to employees the employer reasonably believes may have contributed to the accident.

• Allows employers to designate which type of sample (urine, oral fluid, or breath) will be used for testing and require employees to present reliable identification during collection.

• Updates the statutory definition of "sample" to explicitly include oral fluid in addition to urine and breath.
