HCS CSSB 28(JUD) Summary

• Creates comprehensive sex trafficking and human trafficking statutes establishing three degrees of sex trafficking (AS 11.41.340-11.41.357) and human trafficking offenses with increased criminal penalties, designating sex trafficking in the first degree as an unclassified felony.

• Establishes workplace violence protective orders (AS 18.65.875-18.65.899) allowing employers to petition courts for protective orders against individuals who committed violence or made threats at the workplace, with ex parte orders available and six-month duration.

• Creates the Council on Human and Sex Trafficking in the Department of Public Safety to coordinate victim services, education, public awareness, data collection, and grant programs related to trafficking intervention and prevention.

• Changes terminology from "child pornography" to "child sexual abuse material" throughout statutes and creates new crimes for distribution and possession of generated obscene child sexual abuse material.

• Establishes process for vacating prostitution convictions for persons who were victims of sex trafficking, with rebuttable presumption for those under 21 at time of offense, and provides eligibility for permanent fund dividends upon conviction vacation.
