SB 63 Summary

• Prohibits the governor, state agencies, and municipalities from issuing orders or policies during a disaster emergency that forbid possession, use, or transfer of firearms, firearm accessories, ammunition, or other weapons for personal use.

• Prohibits seizure or confiscation of firearms, firearm accessories, ammunition, or other weapons, and restricts limitations on the quantity or sale of these items during a disaster emergency.

• Prevents closure or limitation of firearms dealers, ammunition sellers, or shooting ranges during a disaster emergency unless the same restrictions apply equally to all commerce within the jurisdiction.

• Prohibits suspension or revocation of concealed handgun carry permits during a disaster emergency and requires acceptance of concealed handgun carry applications that contain required information.

• Allows qualified individuals or membership organizations to bring civil lawsuits in superior court for violations, with prevailing plaintiffs recovering actual economic damages, three times their attorney fees as punitive damages, court costs, and attorney fees.
