HB105 Summary

• Amends Section 16-40-1 of the Alabama Code to modify physical education requirements for public and private schools (excluding church schools).

• Beginning with the 2010-11 school year, all students in grades K-8 must take physical education with no substitutions allowed.

• Physical education may include dance class if taught at a magnet school, or may include marching band, JROTC, or other activities as approved in a student's IEP.

• The act becomes effective on the first day of the third month following passage and approval by the Governor.
