HB144 Summary

• Prohibits persons required to register as sex offenders from obtaining or renewing commercial driver licenses with P (passenger vehicle) or S (school bus) endorsements, effective July 1, 2010.

• Requires the Department of Public Safety to search both the statewide sex offender registry and the National Sex Offender Public Registry before issuing or renewing P or S endorsements.

• Mandates revocation of P or S endorsements for any person convicted of a sex offense on or after July 1, 2010; existing licenseholders may keep licenses until expiration unless they commit a subsequent sex offense.

• Establishes that making a false affidavit regarding sex offender registration status is a Class C felony, and operating a commercial passenger vehicle or school bus without a valid P or S endorsement due to a sex offense conviction is a Class C felony.

• Provides 30-day appeal process for persons denied P or S endorsements to request a hearing before the Department of Public Safety.
