HB146 Summary

• Amends Section 41-9-65 of the Alabama Code to establish requirements for the Board of Adjustment when reviewing county claims for reimbursement of expenses denied by state agencies based on deadline failures.

• Requires state agencies to have promulgated written procedures for reimbursement claims (including timelines) approved by the agency head and distributed to all counties before denying such claims.

• Prohibits the Board of Adjustment from upholding a state agency's denial based solely on deadline non-compliance unless the agency properly applied its written procedures and provided written notice of denial within 14 days with appeal instructions.

• Establishes a 12-month deadline for counties to submit reimbursement requests to state agencies, measured from November 30th following the close of the fiscal year in which the expense was incurred.

• Applies to claims filed on or after October 1, 2009, and became effective immediately upon passage and Governor approval on April 22, 2010.
