HB204 Summary

• Amends Section 12-13-22 of the Code of Alabama 1975 to require persons submitting documents for recording with the probate court to redact, remove, or make illegible Social Security numbers and birthdates before filing.

• Applies redaction requirements to documents that convey interest in real or personal property, encumber property interests, and any other public records filed with the probate court, with exception of federal and state tax liens.

• Authorizes the judge of probate to redact, remove, or make illegible Social Security numbers or birthdates appearing in documents already recorded as public records in the probate court.

• Permits judges of probate to make redacted records available to the public in electronic format and publish such records on the Internet.

• Specifies that failure to comply with redaction requirements does not invalidate or adversely affect recorded documents, and that federal law requirements take precedence in case of conflict.
