HB255 Summary

• Amends Act 99-651 to authorize Mobile County elected officials including the Revenue Commissioner, License Commissioner, Judge of Probate, County Commission, and Sheriff to accept credit card payments for taxes, fees, fines, and penalties.

• Defines "credit card" to include credit cards, charge cards, and debit cards issued by banks and credit card institutions as defined in Alabama Code Section 5-20-3.

• Requires elected officials to charge users a fee to cover the office's processing and transactional costs imposed by credit card companies or banking institutions.

• Prohibits discounts on credit card payments and requires agreements with credit card processors to be cancelable at any time with reasonable notice.

• Provides that credit card payers remain liable for underlying obligations until final payment is received in cash or equivalent, and protects elected officials from personal liability for collection when acting in accordance with applicable policies.
