HB305 Summary

• Amends Section 23-1-5 of the Code of Alabama 1975 regarding utility facility relocation costs when necessitated by highway construction projects.

• For non-interstate highway projects, utilities with gross income of $250,000,000 or less in the preceding calendar year are eligible for state reimbursement of relocation costs, up from the previous threshold of $200,000,000.

• Increases the gross income threshold for newly organized utilities to $250,000,000 or less in their first complete year of operation to qualify for state reimbursement.

• Extends reimbursement eligibility to utilities owned or operated by corporations organized under Article 8, Chapter 50, Title 11 of Alabama Code.

• Becomes effective on the first day of the third month following passage and Governor approval.
