HB32 Summary

• Amends Section 30-3-4.1 of the Code of Alabama 1975 to expand circumstances under which grandparents may petition for visitation rights to minor grandchildren.

• Adds new condition allowing grandparents to seek visitation when a child is living with one or both biological parents who are still married, if parents have prohibited a grandparent relationship.

• Creates a rebuttable presumption that parents with whom a child is living know what is in the child's best interest, placing burden on grandparents to overcome this assumption.

• Specifies that grandparents cannot be granted visitation if a parent has voluntarily given up custody or financially abandoned the child unless the grandparent has an established relationship with the child and visitation is determined to be in the child's best interest.

• Limits grandparents to filing one original visitation action per two-year period and prohibits filing during any year another custody action has been filed concerning the child.
