HB359 Summary

• Amends Alabama Code Section 22-9A-13 to allow mothers or fathers of stillborn children to request a Certificate of Birth Resulting in Stillbirth from the State Registrar within 30 days of occurrence.

• Certificate of Birth Resulting in Stillbirth meets all filing requirements for a live birth certificate, except parents may choose not to include the stillborn child's name if desired.

• Request for the certificate requires payment of the normal fee for a certified copy of a birth certificate.

• Certificates of Birth Resulting in Stillbirth are incorporated into official vital statistics records, unlike other fetal death reports which are destroyed after statistical data is transferred to the Center for Health Statistics database.

• The act is known as the Brooklee Act and becomes effective on the first day of the third month following passage and gubernatorial approval.
