AL HB403

Expands the definition of "disseminate" to include import, export, transfer possession of, display, exhibit, show, present, provide, broadcast, transmit, retransmit, circulate, disperse, or distribute obscene material.

Adds "breast nudity" as a category of visual obscene matter involving persons under age 17, defined as the lewd showing of post-pubertal female breasts below the areola.

Makes knowingly possessing obscene matter depicting children under 17 in sexual acts a Class B felony if possessed with intent to disseminate, and a Class C felony if possessed without dissemination intent.

Establishes that possession of three or more copies of the same visual depiction constitutes prima facie evidence of intent to disseminate.

Provides that each single visual depiction of a child violating the law constitutes a separate offense; effective the first day of the third month following passage and approval.
