HB421 Summary

• Amends Section 11-47-7.1 of the Code of Alabama 1975 to authorize municipal governing bodies individually or jointly to levy additional court costs and fees in municipal cases, not to exceed district court costs and fees for similar cases.

• Requires collected court costs and fees to be deposited into a special "Corrections Fund" that municipalities must allocate exclusively for operation, construction, debt service, and maintenance of municipal jails, contract incarceration fees, correctional facilities, juvenile detention centers, and municipal court complexes including employee salaries.

• Limits municipal allocation to no more than 40 percent of the Corrections Fund for jail and correctional facility operations, with the remainder available for court complex purposes.

• Permits municipalities to appropriate additional funds, accept grants and property, contract for services, and establish joint correctional facilities or court complexes with other governmental entities through resolution or ordinance.

• Becomes effective on the first day of the third month following passage and Governor approval, with no effect on prior local acts or existing contracts.
