• Allows legend drugs dispensed but not administered to patients at hospitals, nursing facilities, assisted living facilities, and specialty care assisted living facilities to be donated to charitable clinics and charitable pharmacies for use by charitable patients at no charge.

• Establishes "charitable pharmacy" as a registered retail pharmacy dispensing free medications to qualifying low-income patients without charging for pharmacy services and without dispensing controlled substances.

• Permits drugs from hospice care programs to be donated under the same conditions as institutional facilities, with drug donation requiring patient or family consent and obliteration of patient identification from containers.

• Authorizes physician drug samples (except controlled substances) to be donated and transferred to charitable clinics and charitable pharmacies for dispensing to charitable patients at no charge.

• Provides liability protections for health care facilities, manufacturers, and their agents transferring drugs under this law except in cases of willful misconduct, with all distributed drugs requiring physician authorization for dispensing.
