HB437 Summary

• Amends Section 11-47-7.1 of the Alabama Code to authorize municipalities to levy additional court costs in municipal courts up to the amount of district court costs for similar cases.

• Additional court costs collected must be deposited into a special "Corrections Fund" and used exclusively for purchasing land, constructing, equipping, operating, and maintaining municipal jails, correctional facilities, juvenile detention centers, or court complexes.

• Allows municipalities to act individually or jointly with other municipalities in the county, and permits receipt of gifts, grants, and property for jail and court complex purposes.

• Authorizes municipalities to contract with other governmental entities to construct and operate joint municipal correctional facilities or court complexes through resolution or ordinance.

• Provides retroactive effect to validate all prior uses and allocations of Corrections Fund monies for land purchase and construction and equipment of municipal jails and court facilities.
