HB527 Summary

• Municipal officials (mayors, council members, city commissioners) who count toward establishing a quorum and miss all regular and special called council or commission meetings for 90 consecutive days are automatically removed from office by operation of law.

• Municipal clerks must record the attendance of all elected municipal officials at each council or commission meeting, regardless of whether a quorum is present.

• Officials absent due to military service are exempt from the automatic removal provision.

• At the next council or commission meeting following removal, the remaining council or commission members may reinstate the removed official by majority vote if mitigating or extenuating circumstances are found.

• If reinstatement does not occur, the vacancy shall be filled according to law; the act becomes effective on the first day of the third month following passage and approval by the Governor.
